Agreement to Terms
By accessing and using the services of Cal Spas At Summit County, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Services Description
Cal Spas At Summit County provides outdoor construction services including but not limited to:
- Patio construction and installation
- Porch building and renovation
- Deck installation and repair
- Gazebo and pergola construction
- Outdoor kitchen installation
- Fire feature construction
- Related outdoor construction services
Project Contracts
All outdoor construction projects are governed by individual contracts that specify:
- Scope of work and project specifications
- Project timeline and completion dates
- Payment terms and schedule
- Material specifications and sourcing
- Warranty and guarantee terms
- Permit and regulatory compliance
Payment Terms
Payment terms are specified in individual project contracts and typically include:
- Deposit required to commence work
- Progress payments during construction
- Final payment upon satisfactory completion
- Acceptable payment methods
- Late payment policies and penalties
Permits and Compliance
Cal Spas At Summit County will assist with necessary permits and ensure compliance with:
- Summit County building codes and regulations
- Colorado state construction requirements
- Local zoning and land use regulations
- Environmental and safety standards
Clients are responsible for providing accurate property information and complying with HOA requirements where applicable.
Weather and Force Majeure
Construction schedules may be affected by weather conditions and other force majeure events including:
- Severe weather conditions
- Natural disasters
- Supply chain disruptions
- Government restrictions or orders
- Other events beyond our reasonable control
We will make reasonable efforts to minimize delays and will communicate any schedule changes promptly.
Material Specifications
All materials used in projects meet or exceed industry standards for Colorado's mountain climate conditions. We reserve the right to substitute materials of equal or superior quality when original specifications are unavailable, with prior client approval.
Warranty and Guarantees
We provide warranties on our workmanship and materials as specified in individual project contracts. Warranty terms vary by project type and materials used. Normal wear and tear, weather damage, and improper maintenance are not covered under warranty.
Client Responsibilities
Clients are responsible for:
- Providing accurate property information
- Ensuring clear access to construction areas
- Protecting valuable items and landscaping
- Following maintenance guidelines
- Obtaining HOA approvals when required
Limitation of Liability
Cal Spas At Summit County's liability is limited to the value of the contracted work. We are not liable for:
- Pre-existing property conditions
- Underground utilities not marked
- Weather-related damage after completion
- Normal wear and tear
- Indirect or consequential damages
Termination
Either party may terminate the contract under conditions specified in the project agreement. Termination may result in additional costs for work completed, materials ordered, and project closeout expenses.
Dispute Resolution
Any disputes arising from these terms or our services will be resolved through good faith negotiation. If unresolved, disputes will be subject to binding arbitration under Colorado law.
Modifications
These terms may be updated from time to time. Clients will be notified of any material changes. Continued use of our services constitutes acceptance of updated terms.
